General Terms and Conditions

To create and use a profile on EliteDulce, you must be at least 18 years of age. Persons under 18 years of age are not permitted to create a profile, use the platform, upload content or communicate with other users via EliteDulce.

You may not use EliteDulce if you have previously been convicted of a sexual offence, abuse, human trafficking, stalking, violence against a partner, crimes against children or other serious crime which, in EliteDulce's assessment, may constitute a security risk to other users.

When creating a profile, you undertake to provide correct, current and accurate information about yourself. It is not permitted to create a profile with false information, another person's identity, another person's email address, another person's telephone number or other information that you are not entitled to use.

You are yourself responsible for ensuring that the information you provide on your profile is lawful, correct and does not infringe the rights of third parties.

When you create a profile on EliteDulce, you accept that the information, images and other profile information that you yourself choose to publish or make visible may be displayed to other users on the platform.

EliteDulce may furthermore use selected profile information for internal platform features, including match suggestions, search, notifications, profile views, recommendations and relevant user interactions.

Depending on your privacy settings and the platform's features, your profile may be displayed on EliteDulce, in internal notifications, in search results, in recommendations or in emails concerning activity on the platform. Only information that you yourself have entered or uploaded, or that is generated as part of your use of the platform, is displayed.

If you no longer wish your profile to be visible, you may delete or deactivate your profile in accordance with the features available on the platform at any given time.

EliteDulce may send you necessary service messages concerning your account, security, payment, subscription, changes to terms, technical notices and other operational matters. Such messages are necessary for the provision of the service and cannot be opted out of as long as you have an active profile.

Newsletters, campaigns, advertisements, discounts and other marketing are only sent to you if you have specifically given your consent thereto, unless otherwise permitted under applicable marketing legislation.

You may unsubscribe from marketing at any time via the unsubscribe link in emails or via your account settings, where the feature is available.

You are responsible for keeping your login details confidential. You may not share your password, account or access to EliteDulce with others.

EliteDulce will never ask you to disclose your password, payment card details, national e-ID or login credentials, bank details or similar sensitive information via the messaging feature, email or chat.

If you suspect that others have gained access to your account, you must immediately change your password and contact EliteDulce's support.

You are liable for the activity that takes place via your account, unless the activity is due to circumstances for which EliteDulce is responsible under applicable law.

EliteDulce may offer free profiles, paid subscriptions, one-time purchases, digital add-ons, virtual currencies, credits, bonus features or other payment-based services.

The platform indicates which features require payment, subscription or separate purchase. Prices, payment period, features and any limitations are displayed before purchase.

Paid features may include, for example, but are not limited to, access to special profile features, messages, notifications, profile visits, gallery access, private gallery, additional profile insight, AI-generated profile texts, special visibility features or other premium features.

A subscription runs until it is cancelled by the user, unless otherwise clearly indicated at the time of purchase. For recurring subscriptions, payment is automatically charged for the agreed subscription period until the subscription is cancelled.

Cancellation must be made via the features indicated on the platform or via the payment provider with which the subscription was created, where relevant.

Non-payment, chargeback, misuse of payment card, fraudulent activity or unjustified objection to payment may result in the blocking or closure of the profile.

EliteDulce does not handle full payment card details directly, unless otherwise expressly indicated. Payments are, as a rule, processed by an external payment provider.

Upon purchase or creation of a subscription, the payment provider may store the necessary payment information, including a tokenised version of the card and possibly the last four digits of the card number, so that future payments can be completed.

Payment information is stored and processed by the payment provider in accordance with applicable rules, including relevant security standards for payment cards.

EliteDulce may send you information about changes to prices, subscriptions, payment terms or material changes to the agreement, to the extent required under applicable law.

Upon purchase of digital services, subscriptions, credits, virtual products or immediate access to paid features, your right of withdrawal may lapse in whole or in part if you expressly consent to delivery commencing immediately and you at the same time acknowledge that you lose the right of withdrawal once the service has been delivered or taken into use.

If the right of withdrawal has not lapsed, the rules following from the Consumer Contracts Act apply.

As a general rule, EliteDulce does not refund payments for services that have been delivered, activated, used or made available, unless otherwise required by mandatory legislation.

EliteDulce wishes to maintain a decent, safe and serious platform. You may therefore not upload, write, share or otherwise publish content that, in EliteDulce's assessment, is unlawful, offensive, misleading, untrue, discriminatory, harassing, threatening, hateful, pornographic, commercially abusive or in breach of these terms. Nudity is not permitted on EliteDulce in any form — not in profile photos, public or private galleries, messages or any other content on the platform.

EliteDulce reserves the right, without prior notice, to reject, hide, change, restrict or delete profiles, profile texts, images, messages, galleries or other content if the content is assessed to be in breach of these terms, applicable law or the purpose of the platform.

In particular, it is not permitted to have content that:

• contains a username that is offensive, misleading, hateful or inappropriate,
• contains direct contact information, including telephone number, email address, address, CPR number, account number or similar,
• contains links to social media, competing platforms, commercial websites or external contact channels, unless EliteDulce expressly permits this,
• contains advertising, spam, affiliate links, sales material or other commercial exploitation,
• impersonates another person,
• infringes copyright, trademark rights, privacy rights or other third-party rights,
• contains nudity, sexually explicit or pornographic content in any form,
• implies, offers, solicits or facilitates prostitution, escort services, sexual services for payment or any other form of exploitation,
• contains paedophilic, minor-related or child-exploitative content of any kind,
• contains threats, harassment, bullying, extortion or attempts at manipulation,
• is racist, sexist, hateful, discriminatory or degrading,
• is intended to harvest email addresses, phone numbers or contact information for spam, marketing or fraud.

Photos uploaded to EliteDulce must be lawful, relevant, accurate and in compliance with these terms. EliteDulce has zero tolerance for nudity: photos containing nudity or sexually explicit content are not permitted anywhere on the platform — including private galleries.

EliteDulce may reject or remove photos if the photo:

• does not depict you,
• is misleading, heavily edited or does not give an accurate impression of you,
• shows nudity, pornography or explicit sexual content,
• shows breasts, genitals or sexual acts,
• contains logos, links, usernames, phone numbers, email addresses or other contact information,
• shows violence, weapons, illegal substances, hateful symbols or illegal activities,
• infringes others' rights, including copyright or privacy,
• shows other identifiable persons without their consent,
• is taken from the internet, social media or third-party websites without documented right of use,
• is of such low quality that the person cannot be recognised,
• is not correctly oriented, contains unnecessary empty space or does not meet technical requirements.

EliteDulce may require additional documentation or a verification photo in order to approve a profile. Professional photos, heavily edited photos or photos from photo sessions are not necessarily sufficient for verification.

If EliteDulce uses manual photo verification, the user may be asked to upload a photo in which the user is holding a physical sign with EliteDulce and the current date. Verification photos are used solely for security and approval purposes, unless otherwise stated in the privacy policy.

You must treat other users respectfully and may not use EliteDulce for unlawful, abusive, harassing, manipulative, threatening or fraudulent purposes. It is also not permitted to send nude images or other sexually explicit material in messages or attachments.

It is not permitted to send messages or content that:

• is harassing, threatening, degrading or intimidating,
• is discriminatory, hateful or offensive,
• contains spam, chain letters, advertisements or mass mailings,
• contains viruses, malware, phishing links or other malicious code,
• attempts to lure users onto external payment, dating, chat or fraud platforms,
• asks for money, advance payment, financial assistance, gift cards, payment of bills, transport, tickets or the like,
• offers money, gifts or other benefits as a condition for sexual services,
• solicits or states hourly rates, meeting rates, service rates or the like,
• facilitates contact with a third party for the purpose of payment, escort, prostitution or the equivalent,
• has the character of extortion, pressure, manipulation or exploitation.

EliteDulce strongly advises against users sending money, gift cards, bank details, personal documents, intimate photos or other sensitive information to persons they do not know.

EliteDulce is a dating and social platform. EliteDulce is not an escort service, prostitution platform, intermediary service for sexual services or a platform for trade in sexual services.

It is strictly prohibited to use EliteDulce to directly or indirectly offer, solicit, arrange, market, broker or facilitate prostitution, escort services, any form of dating, companionship or intimacy in exchange for payment or other consideration, human trafficking or other exploitation.

This includes, among other things:

• stating prices for meetings, time, sexual services or companionship,
• use of phrasings that, in EliteDulce's assessment, in reality have the character of offers to sell or buy,
• profiles whose primary purpose is the sale of pictures, videos, webcam, telephone calls, sexual services or the like — sharing of exclusive content may only take place via the platform's dedicated sharing features, within the platform's content rules and without nudity or sexual material,
• attempts to facilitate contact with other persons for the purpose of sexual services for payment,
• activity that, in EliteDulce's assessment, may be associated with escort, prostitution, human trafficking or exploitation.

Violation of this provision may result in immediate deletion, blocking or permanent exclusion without prior notice and without refund of any payments, to the extent this is permitted under applicable law.

Upon suspicion of unlawful circumstances, EliteDulce may report to the relevant authorities.

EliteDulce has zero tolerance for any form of content, communication or conduct involving minors in a sexual, exploitative, abusive or unlawful context.

If EliteDulce identifies or receives a report of content, conduct or communication concerning exploitation, abuse, grooming, sexual contact with minors or unlawful material, EliteDulce may immediately remove the content, block the profile, secure relevant information and notify the police or other relevant authorities.

Users are encouraged to report profiles, messages, pictures or other content perceived as unlawful, offensive, suspicious, harassing, fraudulent or in breach of these terms.

EliteDulce may review profiles, pictures, profile texts, galleries, messages and other content where there is a report, suspicion of abuse, security considerations, technical reasons or a need to enforce these terms. Reviews may be carried out manually or using automated tools, including on an ongoing basis as part of the platform's normal operation and security.

Review is carried out with respect for users' privacy and in accordance with EliteDulce's privacy policy and applicable data protection rules.

EliteDulce may, at its own discretion, issue a warning, restrict features, hide content, require changes, suspend a profile, block access or delete a profile.

If a user ignores warnings, recommendations or requirements from EliteDulce, this may result in temporary or permanent suspension.

EliteDulce may, without prior notice, suspend, restrict or delete a profile if the user violates these terms, applicable law, payment terms or the platform's security rules.

Material breach includes, among other things:

• false identity,
• fraud, spam or phishing,
• harassment, threats or extortion,
• unlawful content,
• prostitution, escort or sexual services for payment,
• contact with or attempts to contact minors,
• sharing of other persons' private information,
• attempts to circumvent payment, technical restrictions or security measures,
• repeated violations after a warning.

In the event of material breach, amounts already paid may lapse and will, as a general rule, not be refunded, to the extent this is permitted under mandatory law.

As a general rule, you retain ownership of the content you upload to EliteDulce.

By uploading content, you grant EliteDulce a non-exclusive, time-limited and necessary right of use to display, store, process, copy, technically adapt and distribute the content to the extent necessary to operate the platform and provide the service.

You warrant that you have the necessary rights to all content you upload, and that the content does not infringe the rights of others or applicable law.

EliteDulce may remove content if it is assessed to be unlawful, offensive, misleading or in breach of these terms.

EliteDulce processes personal data in accordance with the General Data Protection Regulation, the Data Protection Act and EliteDulce's privacy policy.

EliteDulce may process information such as name, email address, telephone number, age, gender, role, profile information, pictures, payment status, technical data, IP address, log data, messages, user activity and other information necessary for operation, security, payment, support, moderation and the provision of the platform's features.

Under the data protection rules, you have a number of rights, including the right of access, rectification, erasure, restriction, data portability and objection, to the extent the conditions for this are met.

Further information on the processing of personal data is set out in EliteDulce's privacy policy.

If you cannot accept EliteDulce's processing of personal data, you must refrain from using the platform.

EliteDulce makes an active effort to create a safe platform, but EliteDulce cannot guarantee that all users act honestly, lawfully or in accordance with these terms.

You should therefore exercise caution when communicating with other users.

You should never share:

• passwords,
• civil registration number (CPR number),
• bank details,
• payment card details,
• national e-ID and login credentials,
• home address,
• workplace,
• information about children,
• intimate images, unless you fully trust the recipient,
• information that could be used for identity theft, extortion or abuse.

If you have children, you should avoid sharing information about them, including names, images, school, age, address, routines or other identifying information.

EliteDulce recommends that the first physical meeting with another user takes place in a public place and that you inform a trusted person of where you are.

EliteDulce makes the platform available as a digital dating and social service. EliteDulce does not guarantee that you will obtain matches, relationships, messages, meetings, financial benefits or any particular results from using the platform.

EliteDulce is not liable for users' actions, statements, conduct, profiles, images, messages or information, unless otherwise required by mandatory law.

EliteDulce is not a party to agreements, relationships, meetings, payments or other dealings between users.

EliteDulce is not liable for losses arising from a user choosing to share information, send money, meet other users or communicate outside the platform.

EliteDulce does not disclaim liability to the extent that such liability cannot lawfully be disclaimed.

To the extent permitted by applicable law, you agree to hold EliteDulce, its owners, management, employees, business partners and representatives harmless against claims, losses, costs, liability and reasonable legal fees arising from:

• your use of EliteDulce,
• your content,
• your breach of these terms,
• your infringement of third-party rights,
• your unlawful or liability-incurring actions towards other users or third parties.

You shall reasonably cooperate with EliteDulce in handling claims or complaints arising from your use of the platform.

EliteDulce may amend these terms where necessary as a result of changes in legislation, the platform's features, security, payment matters, business model or technical conditions.

Material changes will be communicated to users with reasonable notice, for example by email, notification or clear information on the platform.

If you continue to use EliteDulce after the changes take effect, you are deemed to have accepted the amended terms.

If you cannot accept the changes, you must cease using EliteDulce and, if relevant, delete your profile.

These terms are governed by Danish law, unless mandatory consumer protection rules of another country apply.

Any disputes between EliteDulce and a user shall be sought resolved amicably. If this is not possible, the dispute may be brought before the competent Danish courts, unless otherwise required by mandatory law.

EliteDulce does not conduct criminal record or background checks on users. Although EliteDulce offers verification features, including selfie and ID verification, EliteDulce cannot guarantee any user's identity, intentions, information or behaviour. Verification reduces the risk of misuse but is not a guarantee.

You are solely responsible for your interactions with other users — both on and off the platform, including at physical meetings. Always follow the safety advice in these terms and use common sense.

EliteDulce reserves the right, but is not obliged, to carry out screening, lookups or checks of users within the limits of applicable law.

EliteDulce grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the platform for private, non-commercial use in accordance with these terms.

All rights to the platform, including software, source code, design, texts, graphics, logos, trademarks, databases and features, belong to EliteTreat ApS or EliteTreat ApS' licensors. You may not copy, reproduce, distribute or otherwise exploit the platform's content or elements without prior written consent.

It is not permitted to use scraping, crawling, data harvesting, bots, scripts or other automated access to the platform, to reverse engineer, decompile or modify the platform's software, to circumvent security, payment or access restrictions, to create derivative works, or to use the platform or its data to develop or operate a competing service.

In the event of a breach of this provision, your right of use lapses immediately, and EliteDulce may impose sanctions under the section on deletion, suspension and breach and pursue the claim legally.

EliteDulce may offer virtual credits, items or features (for example "Dulces") that can be purchased and used for features on the platform. Upon purchase you obtain only a limited, personal and revocable right of use — not ownership.

Virtual credits and items have no monetary value, are not a means of payment and cannot be exchanged, redeemed or paid out for money or other assets. They cannot be sold, lent, traded or transferred — neither to other users nor to third parties — and may not be used outside the platform.

EliteDulce may, with reasonable notice, change, replace or phase out virtual credits and items. Unused credits lapse upon deletion of your profile or upon exclusion due to material breach, to the extent permitted by mandatory law.

Purchases of virtual credits and items are subject to the section on the right of withdrawal and digital services.

EliteDulce offers the Privista feature, where approved and verified users ("creators") can offer access to their own digital content, which other users can purchase access to — as one-off purchases or as a subscription to a creator's content. All payments are processed via the platform and the platform's payment provider. Direct payment between users is not permitted and is not supported.

Privista content is subject to all content rules in these terms, including the prohibition against nudity and sexually explicit content and the prohibition against prostitution, escort services and sexual services for payment. The creator warrants that they hold all rights to the content, that all persons depicted are of legal age, and that the content is not shared without the consent of those depicted.

Purchasing access to Privista content grants a personal, non-transferable right to view the content on the platform for as long as the content is available. The content may not be downloaded, copied, recorded, shared or redistributed. Purchases are subject to the section on the right of withdrawal and digital services.

EliteDulce may remove Privista content that breaches these terms, refund purchases and withhold or cancel a creator's earnings in the event of rule violations, suspected fraud or chargebacks. If content is removed, or a creator leaves the platform, access to the content may lapse.

Creators receive a share of the sales price after deduction of the platform's fee. Payouts are made via the platform's payment provider, may require additional verification and only become available after a reasonable holding period. Creators are themselves responsible for reporting and paying taxes and duties on their own earnings.

Privista is the only permitted way to offer paid access to content on EliteDulce. It remains prohibited to sell, offer or request content, services, meetings or companionship for payment outside Privista, cf. the sections on user conduct and the prohibition against prostitution.

Content uploaded or shared by other users belongs to those users. EliteDulce is not responsible for other users' content, cf. the section on limitation of liability.

You may not copy, save, publish, forward, distribute or commercially exploit other users' profiles, photos, videos or messages without their express consent — neither on nor off the platform. This also applies to screenshots and recordings.

If content on the platform infringes your rights, including copyright or the right to your own image, you may contact EliteDulce with documentation of the claim. EliteDulce removes or restricts content following a specific assessment, and users who repeatedly infringe the rights of others may be excluded.

The platform is provided on an "as is" and "as available" basis to the extent permitted by mandatory consumer legislation. EliteDulce does not guarantee that the platform is uninterruptedly available, error-free or free of technical defects.

Downtime may occur as a result of maintenance, updates, technical errors or circumstances beyond EliteDulce's control. EliteDulce is not liable for losses resulting from operational disruptions, outages, data loss or external events, unless otherwise required by mandatory law.

EliteDulce may on an ongoing basis change, improve, add or discontinue features on the platform. Material changes to paid features will be notified in accordance with the section on changes to the terms.

The platform may use or refer to services from third parties, including payment providers, app stores, infrastructure and content providers, as well as external links. Such services are governed by the third party's own terms and privacy policies.

EliteDulce is not responsible for third parties' content, services, availability or actions. Your use of third-party services is at your own risk, and purchases made via app stores may be subject to the relevant store's terms and refund rules.

If any provision of these terms is found invalid or unenforceable, this does not affect the validity of the remaining provisions. An invalid provision shall be replaced by a valid provision that corresponds as closely as possible to the purpose of the original.

EliteDulce's failure to enforce a right or provision does not constitute a waiver of that right or provision.

You may not assign your rights or obligations under these terms without EliteDulce's prior written consent. EliteDulce may assign its rights and obligations to an affiliated company or in connection with a full or partial transfer of business, provided that your rights under these terms are not impaired.

These terms, together with the privacy policy and the cookie policy, constitute the entire agreement between you and EliteDulce regarding the use of the platform.

As a consumer you may, if the relevant conditions are met, submit a complaint to the Danish Centre for Complaint Resolution and the Consumer Complaints Board via Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark, naevneneshus.dk.
