Terms of use
The agreement between you and EliteDulce about using the app, the website and our events – worldwide, with special terms for each region.
Draft – nagkinahanglan og legal review
Bersyon 0.2 · Katapusang na-update Nobyembre 3, 2026
These terms of use are an agreement between you and the company below (“EliteDulce”, “we” or “us”). They apply to the EliteDulce app for iOS and Android, to the web app and the website, and to the events and video features we organise (together “the service”). They apply wherever you use the service. Section 19 contains additional terms for users in particular countries and regions.

The most important points in short
- You must be at least 18 years old, or older if the age of majority is higher where you live. We may ask you to confirm your age.
- EliteDulce is for personal connections. Offering or asking for payment, gifts or other financial support in exchange for company is forbidden, and so are business contacts and sales.
- You choose your segment, Ambitious or Established, yourself. It must be chosen honestly, and it describes a stage in your working life, not income or assets.
- We do not check members’ backgrounds. A verification badge only shows that the selfie matches the profile photos.
- EliteDulce Plus, Gold and Platinum renew automatically until you cancel them. Super Like, Boost and other consumables are rights of use and have no monetary value.
- You only buy in the app through the App Store or Google Play. Cancellation, withdrawal and refunds follow the store’s rules and the mandatory law where you live.
- We may remove content and restrict or close accounts that break the rules. You always receive a statement of reasons and can appeal within 6 months.
- Danish law applies, but you always keep the mandatory consumer rights and the right to go to court that apply where you live. Section 19 describes the rules for your region.
The short summary in italics at the top of each section is only a help. The full text is what applies.
1. Introduction and the agreement
When you use EliteDulce, these terms and the documents they refer to apply.
Welcome to EliteDulce, a dating service where every profile is either Ambitious or Established. The terms apply from the moment you create an account or otherwise use the service until the agreement ends under section 10.
The agreement consists of:
- these terms of use, including the regional terms in section 19
- our community guidelines and policies, which explain in more detail what is allowed
- the purchase terms shown with each purchase and on the plans page
- special terms for events, Speed Date and other features, shown before you sign up
Our privacy policy and cookie policy explain how we process your information. They are not part of the agreement, but please read them before you use the service.
If the documents contradict each other, the special terms for the feature in question take precedence over these terms of use, and these terms take precedence over the community guidelines. If a regional term in section 19 differs from the rest of these terms, the regional term applies to users in that region.
Changes to the terms.
- We may change the terms when the service, the law or our business changes.
- If we make a material change, we will tell you in the app or by email at least 30 days before it takes effect. This does not apply to changes required by law or needed to deal with misuse or a security risk.
- If you do not agree, you can end the agreement and delete your account before the change takes effect.
- A change to section 15, 16 or 19 that puts you in a worse position requires your express acceptance.
The service evolves. We may add, change, test or remove features. Not all features are available in all countries, on all platforms or to all users at the same time. If we remove a feature you have paid for separately, you receive a proportional refund or an equivalent service.
Updates. So that the service can work safely, we may require you to install a newer version of the app. Older versions may stop working.
2. Who may use EliteDulce, and how
You must be an adult, honest and respectful, and you may not misuse the service.
2a. Requirements for you
You may only create an account if:
- you are at least 18 years old and have reached the age of majority where you live
- you are able to enter into a binding agreement
- you have not previously been excluded from EliteDulce, unless we have given you written permission to return
- you have not been convicted of a sexual offence or a serious violent offence
- you are not on the EU’s, the UN’s or other relevant sanctions lists
- you do not have another account
- using the service is not against the law where you live
We may at any time ask you to confirm your age, for example with an electronic ID (such as MitID or BankID where available) or an ID document via our verification partner. If we receive a signal that you may be under 18 or under the age of majority, for example from the App Store or Google Play, we may lock the account until your age has been confirmed. If you do not meet the requirements, you may not use the service, and we may close the account.
2b. Your obligations
You must:
- comply with these terms, the community guidelines and applicable law
- give true information and use photos that show what you look like today
- choose your segment and your field honestly and change them if they no longer fit
- protect your login methods, for example your phone number, email, Apple, Google, Vipps or passkey, and tell us straight away if you think someone else has gained access
- treat other members with respect, also when you turn them down or end a conversation
- follow our advice on safe dates when you meet someone
- only upload contacts that are your own, and only use features such as Contact blocking and Friends of Friends for their intended purpose
2c. Prohibited conduct
You may not:
- offer, ask for or hint at payment, gifts, “arrangements”, regular benefits or other financial support in exchange for company, dates or intimacy
- use the service for business, sales, recruitment, investments, network marketing, advertising or fundraising
- cheat, threaten or trick others out of money, gifts, cryptocurrency or personal information, including through romance and investment scams
- pretend to be someone else, use other people’s photos or share an account with others
- choose a segment that clearly does not fit you in order to be shown to more people
- lie about your age, gender, relationship status or other material facts
- harass, stalk, threaten, bully or intimidate anyone, also after an unmatch or a block
- use Missed Connections, location data or other features to find, monitor or seek out people who do not want it
- share other people’s private information, messages, photos or screenshots without their consent
- record, film or take screenshots of Speed Date, video calls or events without everyone’s consent
- send sexual content to anyone who has not asked for it
- contact minors or share content that sexualises minors
- get around a block, suspension or exclusion, for example with a new account, a new device or another phone number
- create several accounts or buy, sell, lend or transfer accounts
- use robots, scripts, scraping, crawlers, AI agents or other automation to use the service, swipe, write messages or collect data
- get around paywalls, blurred images, limits on likes or other technical restrictions
- copy, decompile or modify the service, try to derive the source code or use the service to develop a competing product
- disrupt or overload the service, spread viruses or attack our systems or anyone else’s
- send false or malicious reports or misuse the complaints system
- offer, sell or broker illegal drugs, weapons or other illegal goods and services
- help or encourage others to do any of the above
If you break the rules, we may act under sections 4 and 10. We may also report the matter to the police and cooperate with the authorities.
2d. Prohibited content
You may not share content that:
- is illegal, or that encourages or glorifies illegal acts
- is sexually explicit or shows nudity in profile photos, prompts or other visible parts of the profile
- shows, sexualises or is aimed at minors
- is threatening, violent, hateful or degrading towards people or groups
- is abusive, harassing or bullying
- contains other people’s personal data, for example phone numbers, addresses or pictures, without their consent
- infringes other people’s copyright, trade marks or other rights
- is false, misleading or manipulated, for example heavily edited or AI-generated photos that give a wrong picture of you
- mentions income, assets, gifts or financial support in connection with company
- advertises products, services, social media, other platforms or paid profiles
- contains links to phishing, malware or scams
- talks about self-harm or suicide in a way that may harm others
- advertises drugs, weapons or gambling
- otherwise breaks the community guidelines
We may remove content that breaks these rules, and we may limit who can see it while we assess it.
3. Content
You are responsible for what you share. Other people’s content may only be used in the service.
The service contains three kinds of content: your own, other members’ and ours.
3a. Your content
You alone are responsible for your content, for example photos, videos, bio, prompts, answers, voice messages, messages, GIFs, your profile song, details of your field and everything you share during events and Speed Date. You confirm that:
- you have the right to share the content, and people who can be recognised in your photos have given their consent
- the content is true and complies with section 2d and the community guidelines
- your profile photos show your face and are not heavily edited, AI-generated or made to mislead
Your profile can be seen by other members, including some you have not chosen yourself. It can also be saved in screenshots, even though we try to prevent it. If you switch on profile sharing, it can also be seen by people who receive a link from you or another member. So do not share anything you do not want others to see.
We may review, analyse, blur, restrict or remove content, both automatically and manually, to enforce the rules and protect members. Section 4 describes how. We have no duty to monitor all content.
3b. Other members’ content
Other members own their own content. You may only use it to use the service as intended. You may not copy, save, share or publish it or use it commercially without the owner’s consent. This also applies to content you see via Likes You, Top Picks, Drops or blurred previews.
We do not check other people’s content in advance and do not guarantee that it is true. If you see something that breaks the rules, report it.
3c. Our content
Everything else in the service belongs to us or our licensors, for example the EliteDulce name, the logo, the design, texts, graphics, stickers, software, algorithms and databases. You may only use it as section 7 allows.
4. Reporting, moderation and consequences
We act on breaches of the rules. You always receive reasons and can appeal.
We do not tolerate behaviour or content that breaks these terms, the community guidelines or the law. You can report it in the app via the profile, the chat or the shield icon. You can also use the report form on the website. People without an account can use it too, for example to notify us of illegal content. You can always block or unmatch a member.
How we moderate. We use a combination of:
- automated tools that assess photos and public profile text, for example for nudity, violence, reused photos and known child sexual abuse material
- tools that only run on your own phone. They warn you before you send an offensive message (“Are you sure?”) and blur a message or picture you receive (“Does this bother you?”). We do not read your private messages to do this
- systems that detect spam, scams, fake accounts and attempts to get around an exclusion, for example based on activity patterns, device, IP address and previously excluded accounts
- human moderators who assess reports and doubtful cases
When you report a conversation, we get access to the messages and photos you choose. We also get access to the rest of the conversation to the extent needed to assess the case.
Consequences. Depending on how serious the breach is, we may:
- remove or blur content
- give you a warning that you must acknowledge
- reset your segment or remove a badge
- show your profile to fewer people or hide it while we investigate
- ask you to complete a selfie or age verification
- restrict features, for example messages, events or purchases
- suspend the account for a period
- close the account and exclude you from the service
If we suspect child sexual abuse, we close the account immediately and report it to the police and the relevant authorities. We may also report other criminal offences.
Statement of reasons. When we remove content or restrict your account, you receive a statement of reasons in the app and by email. It tells you what we have done, which rule it is based on, whether the decision was made automatically and how to appeal. We may leave out the reasons if they could harm an investigation or if the content is spam.
Appeal. You can appeal the decision within 6 months, even if your account has been closed. The appeal is assessed by a different member of staff from the one who made the decision. If we got it wrong, we correct the decision. Depending on where you live, you may also be able to use an out-of-court dispute settlement body, a regulator or the courts; see section 19.
False reports. If you send repeated unfounded reports or appeals, we may, after a warning, stop handling them for a period.
Sharing information. We may share information with the police and other authorities when the law requires it or when it is necessary to protect someone’s life, health or safety. We may also keep information about excluded accounts to stop them signing up again. See the privacy policy.
5. How discovery and recommendations work
We show profiles based on your filters and our recommendations. You can change the filters yourself.
We show you profiles in the swipe deck, Explore, Top Picks, Drops and elsewhere in an order our system calculates. The main parameters are:
- your and the other person’s filters for segment, gender and “Show me”, age and distance. The filters work both ways: you only see a profile if you both fit each other’s filters
- how likely it is that you will both like each other, calculated from how you and similar members have swiped
- how active the profile is, how complete it is and whether it is verified
- whether the profile uses Boost, priority likes or similar paid features that give more visibility
- a small advantage for new profiles and a mix of fields and segments, so you do not only see one type
We never use your gender, your orientation or your segment to set the price or your access to features. The filters for segment, gender, age and distance are free for everyone.
Locations. Distance is calculated from your approximate location. With Passport you can swipe in another city. If you switch on Missed Connections, we store your approximate locations for 7 days. Other members can only see that you have crossed paths in an area, never where you live or work.
Personal offers. The base price is the same for everyone in your country. We may give you offers calculated automatically from, for example, the age of the account, your activity and your previous purchases. In that case it says so next to the offer. You can opt out of personal offers in the settings.
We do not guarantee a particular number of profiles, likes or matches.
6. Privacy
We protect your information. The details are in the privacy policy.
We are the controller of the information we process about you. The privacy policy explains what we collect, why, how long we keep it and what rights you have, including the rights that apply where you live. In particular:
- Gender, “Show me” and sexual orientation: We only process this information with your explicit consent and never share it with advertisers.
- Photo verification: Our partner compares a video selfie with your profile photos. This requires your explicit consent before the recording starts, and we only keep the result.
- Age verification with an electronic ID: We are only told whether you are over 18.
- Contacts: We only receive the ones you choose to upload, and we only store them in a form that cannot be read.
You can withdraw a consent at any time in the settings. This does not affect processing that took place before you withdrew it.
7. Rights we grant you
You may use the service for your own, private use.
As long as you comply with the agreement, we grant you a right to use the service for private, non-commercial use. The right is personal, free of charge and non-exclusive, applies worldwide and can be revoked. You cannot transfer it or let others use it.
The right lapses when the agreement ends or if you break the terms. We may take the legal and technical steps needed to stop unauthorised use, for example blocking devices, IP addresses or accounts.
8. Rights you grant us
You own your content, but you allow us to use it to run and develop the service.
Licence to your content. When you share content in the service, you grant us a licence to store, show, adapt, translate, crop, compress, blur and otherwise use the content. The purpose is to run, secure and improve the service. The licence is free of charge and non-exclusive, applies worldwide and may be passed on to our processors. It also covers your profile being shown to other members in the areas where you are shown, including other places if you use Passport.
Development and safety. You also allow us to use content that has been reported or is publicly visible on your profile to train and test our own models for moderation and safety. This happens in anonymised form. We never use your private messages to train models, and we do not sell your content.
Marketing. We do not use your photos or your name in advertising outside the service unless you have given separate consent to it.
Duration. The licence ends when you delete the content or your account. However, we may keep copies:
- for as long as the law requires
- in backups for a limited period
- as evidence in a moderation case or a legal dispute
Messages you have sent may still be visible to the recipient until the conversation is deleted.
Enforcement. You allow us, but do not oblige us, to act on your behalf if others use your content from the service without permission.
Feedback. If you send us ideas or suggestions, we may use them without paying you or naming you.
Ads. The service may show ads and branded profiles. They are always marked “Ad”. Personalised ads require your consent, and we never use your gender, your orientation or your segment to target ads.
9. Purchases
EliteDulce is free to use. Paid features are bought as a subscription or individually, and subscriptions renew automatically until you cancel them.
You can use EliteDulce for free with a daily limit on likes and with ads. For a fee you can get:
- Subscriptions: EliteDulce Plus, Gold and Platinum for 1, 6 or 12 months. Each level includes the one before. The content is shown at the time of purchase and on the plans page.
- Consumables: for example Super Like, Boost, Super Boost, Primetime Boost, First Impression and read receipts, individually or in packs.
- Event tickets: see 9e.
A subscription may include a fixed number of a consumable, for example a number of Super Likes per week. They apply in the period stated at the time of purchase. If you do not use them, they are not carried over to the next period.
Prices.
- Prices are shown in your local currency including VAT or other sales taxes where the store includes them.
- We may change prices. If the price of a running subscription goes up, you will be told at least 30 days in advance, and the new price only applies from the next renewal. If you do not want to pay the new price, you can cancel the subscription before the renewal.
- If we show an earlier price or a saving, it is based on the lowest price in the last 30 days.
Offers and trial periods.
- Introductory offers, discounts and free trial periods only apply on the conditions and for the period stated with the offer.
- An offer with a countdown expires at the time shown.
- After a trial period, the subscription continues at full price unless you cancel it no later than 24 hours before the trial period ends.
Purchases through several channels. If you have subscriptions through several channels, the highest level applies. If you upgrade through a different channel from the one where you bought your first subscription, the first one is not cancelled automatically, and you do not automatically receive a refund for it. You must cancel it yourself in the channel where you bought it.
9a. Purchases in the App Store and Google Play
When you buy in the app, Apple or Google sells and charges the payment under their own terms. For these purchases:
- The subscription renews automatically for the same period and at the current price unless you cancel it no later than 24 hours before the period ends.
- You cancel and manage the subscription in the App Store or Google Play settings. The subscription does not stop because you delete the app or the account.
- Apple and Google decide refund requests under their own rules. We cannot refund purchases made with them, except where mandatory law requires us to; see 9f and section 19.
- If you change phone or account, you can restore your purchases in the app. A purchase can be moved to another EliteDulce account at most once every 30 days.
9b. No purchases on the website
You cannot buy anything on the website or in the web app. All purchases are made in the app through the App Store or Google Play; see 9a. The website only shows the prices.
9c. Consumables
Consumables are a right to use a feature. They are not money.
- Consumables give you a limited, personal right to use a feature in the service. They have no monetary value, cannot be exchanged for money and cannot be transferred, sold or given to others.
- A consumable has been delivered and used when you activate it, for example when you send a Super Like or start a Boost. A Boost works for the period shown, even if you close the app.
- If you undo a Super Like with Rewind before the recipient has received it, you get it back.
- Unused consumables lapse when the account is deleted or closed, unless 9f or mandatory law says otherwise.
- If a purchase is refunded or reversed, we deduct the corresponding items from your balance.
9d. No guarantee of results
Paid features give more visibility or more options, but we cannot promise a particular number of views, likes, matches or dates.
9e. Events and tickets
We may organise events, for example in-person meet-ups, Speed Date and other gatherings. For some of them you must be photo-verified and check in on site with a QR code. Paid tickets are sold by a partner, and you buy them from the partner under the partner’s terms. We do not sell tickets or accept payment for them. In addition:
- Where the law allows, tickets for an event on a specific date are not covered by a right of withdrawal.
- If the event is cancelled, you get the ticket price back from the partner.
- If you break the rules, we may refuse you entry or remove you from the event without a refund.
9f. Withdrawal and refunds
Purchases in the app follow the App Store’s and Google Play’s rules on withdrawal and refunds – plus the mandatory rights where you live.
All purchases are made in the App Store or Google Play, and Apple or Google is the seller. Requests for withdrawal and refunds are therefore handled by the store; see 9a. Section 19 describes the rights to withdraw or cancel that apply in particular countries.
We only refund ourselves when the law requires it, for example if the service is defective or a mandatory right to cancel requires a refund that the store does not give. If we close your account because you have broken the terms, we do not refund the remaining part of a paid period unless the law requires it.
10. Pause, deletion and closure
You can always pause or delete your account. We may close it if you break the rules.
Pause. You can pause your profile in the settings. You are then not shown to new people but can still write to your matches.
Deletion.
- You can delete your account in the app, in your account on the web or via the page about deleting your account.
- You can choose to delete the account immediately or with 90 days to change your mind. If you log in again within the 90 days, the account is restored.
- Your profile is hidden straight away.
- Subscriptions in the App Store and Google Play must be cancelled by you in the store. Otherwise you will keep being charged.
When we close your account. We may suspend or close your account:
- if you break the agreement
- if the law requires it
- if we have reasonable suspicion of fraud or of danger to others
- if the account has not been used for more than 2 years
In the case of material breaches we may close the account without notice. In other cases we give you at least 30 days’ notice. You always receive a statement of reasons; see section 4.
If we close your account, we cancel subscriptions bought in Google Play. Apple does not allow us to cancel subscriptions for you, so you must cancel an App Store subscription yourself.
If we close the service. If we close EliteDulce entirely or in your country, we give you at least 30 days’ notice. You receive a proportional refund for paid periods and a refund for unused consumables.
For the safety of members, we may keep certain information about closed accounts to stop them signing up again, as described in the privacy policy. Sections 3, 8 and 11–19 continue to apply after the agreement has ended.
11. Safety, verification and no background checks
We do not check members’ backgrounds. Look after yourself when you meet new people.
YOU UNDERSTAND THAT WE DO NOT CARRY OUT BACKGROUND CHECKS ON MEMBERS, INCLUDING CRIMINAL RECORD CHECKS, AND THAT WE DO NOT CHECK THEIR IDENTITY, AGE, SEGMENT, FIELD, RELATIONSHIP STATUS OR OTHER INFORMATION UNLESS EXPRESSLY STATED BELOW.
Our badges only mean the following:
- Photo verified: The person’s video selfie resembled the profile photos when the verification was completed. The badge may disappear if the photos are replaced.
- Age confirmed: The person has shown with an electronic ID or an ID document that they are over 18.
- Campus: The person has access to an email address at a university.
A badge is not a guarantee of who the person is or how they will behave. Segment and field are the member’s own information.
Safety tools. Share my date, Date safety with a check-in timer and SMS to your trusted contacts, the emergency button and our advice are aids. They are not an alarm or monitoring service, and we cannot guarantee that a message or SMS will be delivered. If you are in danger, call the local emergency number (112 in Europe).
Video and Speed Date. We do not record video calls or Speed Date. You can end a call at any time and report the other person.
YOU ARE RESPONSIBLE FOR YOUR CONTACT WITH OTHER MEMBERS, BOTH IN AND OUTSIDE THE SERVICE.
- Never share sensitive information, passwords or payment details.
- Never send money to anyone you have met on EliteDulce, whatever they tell you.
- Meet in a public place the first time, and tell a friend where you are.
12. Disclaimer
The service is provided as it is, within the limits of the law.
TO THE EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE GIVE NO WARRANTIES OTHER THAN THOSE IN THESE TERMS OR THOSE THAT FOLLOW FROM MANDATORY LAW. IN PARTICULAR, WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT YOU WILL FIND A PARTNER.
WE DO NOT GUARANTEE THAT INFORMATION FROM OTHER MEMBERS IS TRUE, AND WE ARE NOT RESPONSIBLE FOR MEMBERS’ BEHAVIOUR, EITHER IN OR OUTSIDE THE SERVICE.
Automated features can make mistakes. This applies, for example, to recommendations, translations, warnings about offensive language, image blurring and spam filters. They are an aid and cannot replace your own judgement.
Your mandatory rights as a consumer, for example if the service is defective or not as described, are not affected. Section 19 gives examples for particular regions.
13. Infringements of rights
If you believe your content is being used without permission, write to us.
If you believe content in the service infringes your copyright or other rights, send a notice via the contact page. Read more on the page about intellectual property, which also describes the procedure under the US Digital Millennium Copyright Act. The notice must contain:
- your name and contact details
- a description of the work or the right
- where the content is, for example the profile’s user name or a screenshot
- a statement that you believe in good faith that the use is not permitted
- a statement that the information is correct and that you are the rights holder or act on their behalf
We handle the notice quickly and remove the content if the notice is justified. The member is told and can appeal. Repeated infringements lead to the account being closed.
14. Third parties and ads
We are not responsible for other people’s services that you use through EliteDulce.
The service may contain ads, links and features from third parties, for example:
- login with Apple, Google or Vipps
- payment via Apple and Google
- music from iTunes or Spotify
- GIFs from GIPHY
- maps and verification from our partners
When you use them, their own terms may apply. We are not responsible for third parties’ content, products or services, and an ad is not a recommendation from us. If you deal with an advertiser, you enter into the agreement with the advertiser and not with us.
15. Limitation of liability
Our liability is limited, but never for intent, gross negligence or personal injury.
TO THE EXTENT THE LAW ALLOWS, WE, OUR MANAGEMENT, EMPLOYEES AND PARTNERS ARE NOT LIABLE FOR:
- indirect loss, consequential damage, lost profits, lost data or lost goodwill
- loss caused by other members’ or third parties’ behaviour or content, in or outside the service
- loss caused by unauthorised access to your account that you could have prevented
TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY TO YOU CAN NEVER EXCEED THE HIGHER OF (A) DKK 1,000 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY) AND (B) THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.
The limitations do not apply in the case of intent or gross negligence, personal injury or death that we have caused, or where mandatory law entitles you to more.
16. Complaints and disputes
Contact us first. If that does not solve the matter, you can use a complaints body or go to court where you live.
16a. Contact us first. If you are dissatisfied, write to us via the contact page or via Settings → Help in the app. We answer in Danish, Swedish, Norwegian and English and try to solve the matter within 30 days. This does not apply to moderation decisions, which have their own appeal route; see section 4.
16b. Complaints bodies. Depending on where you live, you can bring a complaint before a consumer complaints body, a regulator or an out-of-court dispute settlement body. Section 19 describes the options in each region.
16c. Governing law. The agreement is governed by Danish law, without regard to its conflict-of-law rules. If you are a consumer living in another country, you keep the protection that the mandatory rules of your country give you. Section 19 gives examples.
16d. Venue. Disputes are settled by the City Court of Copenhagen (Københavns Byret) as the court of first instance. If you are a consumer, you can always bring proceedings in the courts where you live when the law of your country gives you that right, and in that case we can only bring proceedings against you there.
17. Indemnity
If we are held liable for something you have done, you must cover the loss.
To the extent the law allows, you must indemnify us, our management, employees and partners against claims from third parties, including reasonable legal costs. This applies to claims arising because you have, in a way you are responsible for, broken these terms or the law, or because your content infringes other people’s rights. We will tell you about such claims and will not settle them without having heard you.
18. General provisions
The terms make up the whole agreement between us.
- Entire agreement. The terms and the documents listed in section 1 make up the entire agreement between you and us about the service.
- Invalidity. If a provision is invalid, the rest of the agreement continues to apply. The invalid provision is replaced by a valid one that comes as close to the original as possible.
- No waiver. Even if we fail to enforce a provision, we do not waive it.
- Assignment. You cannot assign the agreement. We may assign it to a company that takes over the service if your rights are not reduced. You will be told and can end the agreement.
- Force majeure. We are not liable for delays or failures caused by circumstances outside our control, for example outages at suppliers, cyberattacks, strikes or natural disasters.
- Language. The terms are available in several languages. The language version you accepted applies to you.
- No partnership. The agreement does not make you an employee, agent or partner of EliteDulce.
- Apple. If you downloaded the app from the App Store, the following also applies:
- The agreement is between you and us, not with Apple.
- Apple has no obligation to provide maintenance or support.
- Apple is not responsible for claims about the app, including product liability claims, claims about failure to comply with legislation and claims about infringement of third parties’ intellectual property rights.
- Apple and Apple’s subsidiaries have the right as third parties to enforce this agreement.
- Contact. The company details are at the top. The contact form on the contact page is also our point of contact under the EU Digital Services Act (DSA art. 11 and 12).
19. Regional terms
Where you live can give you extra rights. The terms below apply to users in the region concerned and take precedence over the rest of the terms for those users.
All the regional terms are shown to everyone. If you live in a country that is not mentioned, section 19l applies. Nothing in this section limits rights that you have under mandatory law.
19a. European Union and the EEA
- Consumer law. Danish law applies, but you keep the protection of the mandatory consumer rules of the EU or EEA country where you live. You can bring proceedings in the courts where you live, and we can only bring proceedings against you there.
- Right of withdrawal. You have a 14-day right of withdrawal for purchases of digital services and digital content. If you have expressly asked for the service to start immediately and acknowledged that you thereby lose the right of withdrawal for the part that has been delivered, the right of withdrawal lapses for that part. Since Apple or Google is the seller, you use the right of withdrawal through the store; see 9a.
- Defective service. If the service is not as agreed, you have the rights that the law of your country gives you, for example to have the defect remedied, a price reduction or to end the agreement.
- Complaints about purchases. Because we are a Danish company, complaints about purchases can be brought before the Danish Consumer Complaints Board (Forbrugerklagenævnet) via Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark, naevneneshus.dk. If you live in another EU or EEA country, the European Consumer Centre in your country can help you free of charge with a cross-border complaint.
- Digital Services Act. In the EU we follow the Digital Services Act (DSA):
- Anyone, including people without an account, can notify us of illegal content via the report form (art. 16).
- You receive a statement of reasons when we restrict your content or account (art. 17) and can appeal free of charge via our internal complaint-handling system (art. 20).
- You can bring a moderation decision before a certified out-of-court dispute settlement body (art. 21). We will engage with the body in good faith.
- The main parameters of our recommender system are described in section 5 (art. 27). Ads are marked and are never targeted using special categories of personal data such as sexual orientation (art. 26).
- Our point of contact for users and authorities is the contact form on the contact page (art. 11 and 12). We communicate in Danish, Swedish, Norwegian and English.
- You can complain about an infringement of the DSA to the Digital Services Coordinator in the member state where you live (art. 53).
- We publish the average monthly number of active recipients in the EU here: [UDFYLDES: link til DSA-oplysning om gennemsnitligt antal aktive modtagere].
- We give users in the EEA outside the EU the same rights to notices, reasons and appeals.
19b. Germany

You can bring proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live.
- Cancellation. You have a 14-day right to cancel purchases of digital services and digital content under the Consumer Contracts Regulations 2013. If you have expressly asked for the service to start immediately and acknowledged that you thereby lose the right to cancel, the right lapses for the part that has been delivered. You also have the rights that UK law gives you for subscription contracts. Since Apple or Google is the seller, you cancel through the store; see 9a.
- Online Safety Act 2023. You can report illegal content to us via the report form and complain about how we have handled a report, about content being removed or restricted, or about action against your account, via our complaints and appeals pages. We handle complaints under the same procedure as described in section 4. Ofcom regulates online safety in the UK but does not handle individual complaints.

You keep the protection of the mandatory Swiss consumer rules, and you can bring proceedings in the courts where you live. Swiss law does not give a general right of withdrawal for online purchases; the store’s rules apply; see 9a.

- Governing law. Danish law applies to the agreement except where the law of your state gives you protection that cannot be waived by agreement. Nothing in these terms prevents you from bringing a claim in a small claims court where you live, if that court has jurisdiction.
- Right to cancel a dating service. If you live in a state whose law gives you a right to cancel a dating service subscription within a certain period (for example three business days) or a right to a refund in the event of death or disability, you have that right. Ask the store for a refund first; if the store refuses, contact us via the contact page, and we will refund what the law requires.
- Subscriptions. Before you subscribe, the store shows the price, the period and the renewal terms. You can cancel online in the store at any time; see 9a.

19g. Australia
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under the Australian Consumer Law, and the limitations in sections 12 and 15 only apply to the extent the Australian Consumer Law permits. If we do not remove serious online abuse or illegal content that you have reported to us, you can complain to the eSafety Commissioner at esafety.gov.au.
19h. Brazil
You keep the protection of the Brazilian Consumer Defence Code.
